Welcome to DarkOffset (“we”, “us”, “our”). By purchasing, downloading, or using any software, license, or service offered through this website (the “Service”), you (the “User”) agree to be bound by these Terms & Conditions. If you do not agree, do not purchase or use the Service.

1. Nature of the Service

DarkOffset provides software modifications (“cheats”, “loaders”, “tools”) that interact with third-party video games for entertainment and educational purposes. The Service is provided “as is” and “as available”, without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

2. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to purchase the Service. By purchasing, you confirm that you are of legal age and have the authority to enter into this agreement.

3. License Grant

Upon purchase, you receive a non-transferable, non-exclusive, revocable license to use the Service for personal, non-commercial use during the active subscription period. You may not:

• Resell, redistribute, share, sublicense, lease, or rent the Service;
• Reverse-engineer, decompile, disassemble, dump, or extract source code or assets from the Service;
• Publicly disclose, leak, or upload any portion of the Service to public repositories, forums, or file-sharing platforms;
• Bypass or attempt to bypass the hardware-ID lock, license check, or any other protection mechanism.

Any violation of this section immediately terminates your license without refund and may result in a permanent block of your hardware ID (HWID) across all of our products.

4. Game Activity

Use of the Service may violate the Terms of Service of the game(s) it interacts with. By purchasing, you acknowledge and accept that:

• The use of cheats and game modifications carries an inherent and significant risk of detection by anti-cheat systems.
• Account bans, hardware bans, console bans, game restrictions, loss of in-game progress, loss of in-game purchases, loss of in-game items, or any other punitive action taken by the game publisher, platform, or anti-cheat provider are entirely your own responsibility.
• We are not liable for, and you waive any claim against us in relation to, any ban, suspension, loss of in-game items, loss of progress, loss of account access, hardware ban, or any other consequence resulting from use of the Service.
• An “undetected” status displayed on this website indicates only the current state at the time of writing and is never a guarantee of future undetectability.
• You assume all risk of detection knowingly and voluntarily.

5. Service Availability & Game Updates

The Service operates by interacting with games that are under the exclusive control of their respective publishers. We have no control over game updates, anti-cheat updates, or publisher policy changes.

You acknowledge and agree that:

• Game updates, patches, anti-cheat updates, or changes to the game’s code or online infrastructure may render the Service partially or entirely non-functional, temporarily or permanently.
• We may, at our sole discretion, pause, modify, or permanently discontinue any cheat, feature, or the entire Service if it is no longer technically viable, no longer safe to operate, or no longer commercially reasonable to maintain.
• We are not liable for any downtime, loss of functionality, or discontinuation of the Service caused by external factors including but not limited to game updates, anti-cheat changes, server changes by the publisher, legal action by the publisher, payment processor policy changes, or force-majeure events.
• Where reasonably possible we will attempt to restore service; however, no timeline, fix, alternative, or replacement product is promised or guaranteed.

6. Payments & Refunds

All prices are listed in the currency displayed at checkout. Payments are processed by independent third-party providers (Stripe, PayPal); by paying you also agree to those providers’ respective terms of service and privacy policies.

All sales are final. Because the Service consists of digital content that is made available for immediate use and delivery upon completion of purchase, you expressly:

• Request that performance of the Service begin immediately upon completion of your purchase; and
• Acknowledge that, by making such request, you thereby waive any statutory right of withdrawal (“herroepingsrecht” under Dutch and EU consumer law) to the maximum extent permitted by applicable law.

No refunds, partial refunds, credits, or substitutions will be issued for, including but not limited to:

• Account bans, hardware bans, or anti-cheat detections;
• Dissatisfaction with features, performance, or visual presentation;
• Inability to run the Service on your particular system configuration;
• Interference by antivirus or other security software;
• Partial use of a subscription period;
• Unused remaining time after voluntary cancellation;
• The Service becoming non-functional due to a game update or anti-cheat update;
• The Service being discontinued as described in Section 5.

Chargebacks initiated without first contacting our support will be considered a material breach of these Terms and may result in permanent blocking of your HWID across all of our products and forwarding of relevant evidence to the payment processor.

7. Subscription & Cancellation

Subscriptions are billed for the period selected at checkout (monthly or yearly) and renew automatically unless cancelled. You may cancel future renewals at any time from your dashboard; cancellation prevents further charges but does not entitle you to a refund of the current period.

8. User Conduct

You agree that you will not:

• Share your account credentials, license key, or downloaded files with any third party;
• Use the Service on more than the number of devices permitted by your license;
• Attempt to circumvent or tamper with the HWID lock or license check;
• Use the Service to harm, harass, dox, threaten, or defraud other players in ways that exceed the intended use of the cheats provided;
• Use the Service for any unlawful purpose or in any way that infringes on the rights of third parties.

Breach of this section results in immediate termination without refund.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall DarkOffset, its operators, owners, employees, contractors, or affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of accounts, loss of in-game items, loss of in-game currency, loss of data, loss of profits, loss of goodwill, loss of business, or any damages arising from bans, detections, or discontinuation of the Service — even if we have been advised of the possibility of such damages.

To the extent that liability cannot be excluded by mandatory applicable law, our total aggregate liability to you for any and all claims arising out of or relating to the Service is limited to the total amount you paid to us in the three (3) months immediately preceding the event giving rise to the claim.

10. Indemnity

You agree to indemnify, defend, and hold harmless DarkOffset and its operators from and against any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or related to: (a) your use of the Service, (b) your breach of these Terms, or (c) your violation of any third-party right, including game publisher Terms of Service.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, including but not limited to cases of: suspected leaking or sharing, chargeback fraud, abuse of support, abuse of other users, or any breach of these Terms. No refund will be issued for terminations resulting from a breach attributable to you.

12. Privacy & Telemetry

The Service collects technical data necessary for license enforcement, fraud prevention, and operation, including: hardware identifiers (HWID), IP address, PC name, loader version, a list of relevant running processes during sessions, and timestamps. By using the Service you consent to this collection. Data is used solely for the operation and protection of the Service and is not sold to third parties. We may retain data for as long as your account exists plus a reasonable period thereafter for fraud-prevention and legal-compliance purposes.

13. Intellectual Property

All intellectual property in the Service, including but not limited to source code, binaries, graphics, branding, and documentation, remains the exclusive property of DarkOffset. Nothing in these Terms transfers ownership of any intellectual property to you.

All game titles, trademarks, registered trademarks, product names, and company names referenced on this site are the property of their respective owners. DarkOffset is an independent project and is not affiliated with, endorsed by, sponsored by, or in any way officially connected with any game publisher, developer, or platform mentioned.

14. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates the most recent revision. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be brought exclusively before the competent courts of the Netherlands, except where mandatory consumer protection law of your country of residence grants you the right to bring proceedings in your local courts.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and DarkOffset regarding the Service, superseding any prior or contemporaneous agreements, communications, or proposals, whether oral or written.
